These Terms and Conditions ("Agreement") establish a legally binding agreement between users ("You," "User," "Subscriber," "Customer") and Swift Charge, a registered Corporation operating under the laws of Canada ("Swift Charge," "We," "Us," "Our"). This Agreement outlines the terms governing the utilization of the EV charging network services ("Services") provided by Swift Charge through its official website. Your use of the Services signifies your acceptance of and compliance with these terms.
1. Acceptance of Terms
By accessing or using the Services on our official website, you confirm that you have thoroughly reviewed, understood, and agreed to adhere to these Terms and Conditions, in addition to any other pertinent guidelines and policies referred to within this document.
2. Service Description
Swift Charge extends access to a network of electric vehicle charging stations ("Charging Stations") via the Services. The availability, locations, and features of Charging Stations may be subject to modifications without prior notice.
3. User Accounts
To avail the Services, you may be required to create a user account. If an account is required, you are solely responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and up-to-date information during registration and to promptly update any modifications.
4. Use of Services
4.1. You undertake to utilize the Services exclusively for the purpose of charging electric vehicles and in compliance with all relevant laws and regulations.
4.2. Usage of the Services for unlawful, fraudulent, or unauthorized activities is strictly prohibited.
4.3. Any tampering, damage, or misuse of Charging Stations, related equipment, or the Services is strictly prohibited.
5. Fees and Payments
5.1. Usage of the Services may be subject to charges, which will be clearly communicated prior to initiating a charging session.
5.2. You authorize Swift Charge to charge your chosen payment method for all applicable fees associated with your usage of the Services.
6. Intellectual Property
All intellectual property rights related to the Services, including trademarks, copyrights, and proprietary information, are the exclusive property of Swift Charge. You shall not reproduce, distribute, or create derivative works based on the Services without explicit consent from Swift Charge.
7. Privacy
Swift Charge's Privacy Policy details the collection, usage, and sharing of user data. By using the Services, you consent to the privacy practices outlined in the Privacy Policy.
8. Limitation of Liability
To the maximum extent permissible by law, Swift Charge shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the Services or this Agreement.
